Terms of Service

These terms govern every service you buy from Any Cloud — colocation, dedicated servers and virtual private servers. Ordering a service means you accept them.

1. Who these terms are between

These terms are an agreement between you (the "Customer") and AnyCloud Singapore Limited, trading as Any Cloud ("we", "us"). If you are ordering on behalf of a company, you confirm you are authorised to bind it.

We can be reached at andy@shota.hk. Support runs 24 hours a day, seven days a week, in English and Chinese, by email ticket, with a first reply inside one hour.

2. What we provide

We provide three services, all housed in Equinix IBX data centres:

  • Colocation — rack space by the unit or the full 42U rack, in Hong Kong (HK1), Singapore (SG1), Tokyo (TY1), Frankfurt (FR1) and Los Angeles (LA1).
  • Dedicated servers — single-tenant physical machines that we own, rack and maintain, in the same five locations.
  • Virtual private servers — KVM instances on our own hardware, in Hong Kong and Singapore only.

We do not provide operating-system administration, application support, software licences, or data backup, unless a separate written agreement says we do.

3. Term, renewal and price

Services are sold on a monthly or an annual subscription, chosen per service rather than per account. A monthly subscription renews each month until you cancel. An annual subscription bills eleven months for twelve — one month free — is charged in advance, and holds your rate for the whole term.

Switching from monthly to annual takes effect at your next renewal date. Time you have already paid for is not lost; it carries into the annual term.

Prices published on our website are the prices we charge. We may change published prices for future terms, but never inside a term you have already paid for.

4. Fees, tax and currency

Colocation and dedicated servers are priced in US dollars. Virtual private servers are priced in Singapore dollars. Where you ask to be billed in the other currency, we convert at the exchange rate on the day the invoice is issued.

All published prices include Singapore tax. Nothing further is added at checkout.

We accept credit card, WeChat Pay, Alipay, USDT, PayNow (Singapore) and bank transfer.

Setup fees: colocation carries a one-off setup fee of USD 180. Dedicated servers carry a one-off setup fee of USD 80, waived if you commit to a twelve-month term.

5. Cancelling

A virtual private server can be cancelled at any time and stops billing at the end of the paid period.

Colocation and dedicated servers require 60 days written notice before the date you want the service to stop. Colocation equipment removal is scheduled inside that window so that access and hands can be arranged.

A dedicated server cancelled part-way through its committed term forfeits the deposit in full.

5a. Dedicated server deposits

Dedicated servers on a committed term carry a deposit calculated from that machine’s own monthly rent:

  • Three-month term — one month deposit, one month paid in advance.
  • Six-month term — two months deposit, one month paid in advance.
  • Twelve-month term — three months deposit, one month paid in advance.

The deposit is returned at the end of the term, provided the term ran to completion and nothing is outstanding.

6. Availability commitment

We commit to 99.99% availability. If we miss it in a calendar month, we extend your service term by 1.5 times the measured downtime, rounded. For example, sixty minutes of downtime becomes ninety minutes of additional service.

We compensate in service time. We do not issue refunds for downtime, and the extension is your sole and exclusive remedy for a missed availability commitment.

The commitment does not cover downtime caused by your own hardware, software or configuration; by scheduled maintenance we have announced in advance; by your breach of these terms or the Acceptable Use Policy; or by events outside our reasonable control.

To claim, open a ticket within thirty days of the incident with the times and the effect you observed.

7. Backups are yours

We do not take snapshots or backups of your data, on any service. Nothing you store with us is copied anywhere else by us.

If your data matters, back it up yourself, off this platform. On termination for any reason, data on our hardware is deleted and cannot be recovered.

8. Dedicated server hardware

We replace failed hardware within 24 hours at no charge. Every machine provides IPMI console and remote media, except a small number of consumer-CPU builds.

Where the failure was caused by how you used the machine — sustained mining loads, packet flooding, or anything else that breaches the Acceptable Use Policy — the replacement cost is billed to you.

Stock machines are handed over within one hour in Hong Kong, Singapore and Tokyo, and within twelve hours in Frankfurt and Los Angeles. Custom builds are quoted and scheduled by email.

DDoS mitigation is not included and is purchased separately.

9. Colocation

You own and insure the equipment you place in our racks. You are responsible for its condition, its configuration and anything it does on the network.

Power is metered separately and billed on peak draw at USD 900 per kVA per month before the site multiplier. Space, included bandwidth and one management IP address are in the rate.

Remote hands is USD 80 per hour. No hours are included in the monthly fee. Cross-connects are USD 100 each.

Site access follows the rules of the Equinix facility that houses your rack, including its named-list requirement, identification checks and booking notice. We arrange access on your behalf; tell us who is coming and when.

10. Bandwidth

Colocation includes 100 Mbps on a single unit and 500 Mbps on a full rack. Overage settles monthly at USD 0.35 per Mbps.

You may take a fixed committed rate or 95th-percentile billing. Which one applies is agreed before you order; 95th-percentile billing requires a deposit.

Virtual private server bandwidth is shared, between 100 and 300 Mbps depending on plan, with a monthly traffic allowance stated on the plan.

11. IP addresses

Colocation includes a /32 as the management address for your deployment. Dedicated servers include a /29. Virtual private servers include one to three IPv4 addresses depending on plan, and a /64 of IPv6.

Additional IPv4 addresses are SGD 5 per address per month. All addresses are assigned to you for the life of the service and remain ours; they are not portable and cannot be transferred to another provider.

12. Acceptable use

Your use of every service is subject to our Acceptable Use Policy, which forms part of these terms.

13. Suspension and termination

We may suspend a service without notice where it is causing harm to the network, to other customers or to our facilities, or where it breaches the Acceptable Use Policy. We will tell you why as soon as we reasonably can.

An invoice that is seven days overdue ends the service. For dedicated servers the invoice is issued in advance: the machine is powered off on the due date, and if the invoice is still unpaid seven days later the machine is wiped and returned to stock.

Suspension or termination for breach does not entitle you to a refund, and does not release you from fees already due.

14. Liability

Our total liability to you for any claim in a twelve-month period is limited to the fees you paid us for the affected service in that period.

We are not liable for lost profits, lost revenue, lost or corrupted data, or any indirect or consequential loss. Given that we take no backups, loss of data is a risk you accept and mitigate yourself.

Nothing here limits liability that cannot lawfully be limited.

15. Changes

We may change these terms. Material changes take effect at your next renewal, and we will tell you by email before they do. Continuing to use the service after that is acceptance.

16. Governing law

These terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction over any dispute.
